Subject
For the first purchaser/user (Customer), Marmo Arredo S.p.A. (Marmo Arredo) guarantees, for a period of 2 (two) years, that the bathroom tops and kitchen countertops supplied (the Products) comply with orders (Legal Warranty).
Marmo Arredo also guarantees, for a period of 25 (twenty-five) years, that the quartz and resin agglomerate material used to manufacture the Products will be free from structural defects in the composition of the material itself (Conventional Warranty). Marmo Arredo offers the Customer no other legal or conventional warranty, whether implicit or explicit. These guarantees only apply to products that have been duly paid for in full.
Conditions
The aforementioned guarantee periods of 2 and 25 years respectively, commence from the delivery date of the product as stated on the transport document and may in no way be suspended or extended as a result of the Products not being used, even if due to repairs while under guarantee. The Customer will forgo the Legal Warranty if any defects or non-conformity in the Product are not declared within 60 (sixty) days of the date they were (or should have been) discovered, by sending a registered letter with return receipt to Marmo Arredo describing the defects found and the maintenance methods used.
The Conventional Warranty will be granted only if the Customer requests activation within 8 days of the date on which the defect was (or should have been) discovered, by sending a registered letter with return receipt to Marmo Arredo describing the defects found and the maintenance methods used.
Warranty exclusions
The warranty is only valid if the above instructions, downloadable from www.marmoarredo.com, are observed.
The warranties do not cover any products resulting from the improper use of the material. Any compositions with a special dimensional conformation that have been created without having been the subject of a prior feasibility study approved in writing by Marmo Arredo, are also excluded from the warranties.
The warranty will be void in the following circumstances:
• the Customer has directly intervened on the Product;
• third parties have intervened to restore and/or repair the Product without prior written authorisation from Marmo Arredo;
• the Product has been altered by third parties without prior written authorisation from Marmo Arredo.
The warranty will not apply in the following circumstances:
• products have been subjected to “thermal shock” or damage due to failure to use appropriate protection from direct or indirect sources of heat;
• products have been subjected to overloading;
• defects have been caused by normal usage (scratches, abrasions or breakages);
• the Product has been used for a purpose other than the one for which the Product was designed;
• products have been subjected to the abuse of chemical substances;
• products have been used in areas with climatic variations and extreme temperatures;
• products have been installed incorrectly;
• products have been installed with damaged or broken components;
• tampering, negligence, abuse or improper use of the Product has occurred.
Content
If the defect is promptly reported, Marmo Arredo will be entitled to examine, at its own discretion, the Products concerned, and send a technician to carry out an inspection to establish the nature of the defect and its cause.
If defects should be found in the Product covered by the warranty, the Customer will be entitled to have the Product repaired or replaced free of charge, as decided by Marmo Arredo.
However, if the technician establishes that the defect is not covered by the warranty, all costs related to the inspection and any repair and/or replacement work – including labour, transport, room and board, and replacement materials – will be charged to the Customer.
Warranties for Products replaced or repaired in accordance with the paragraph above remain in force only for the remaining period between the repair and/or replacement and the expiry of the original guarantee period regarding the Product originally purchased by the Customer.
No other form of intervention under warranty and/or compensation may be claimed by the Customer, with the express exclusion of any liability for direct, indirect, incidental or consequential damages that may arise from the defects and/or non-conformity of the Products, which must therefore, to the extent permitted by law, be considered expressly waived by the Customer.
Final clauses
These general guarantee conditions are governed by Italian law.
Any dispute arising from or regarding these general conditions or the use of the Product will be referred to the exclusive jurisdiction of the Court of Padua, Italy.
Should any clause in these general conditions be ruled as invalid, illicit or ineffective by the competent legal authority, the remaining clauses will continue to remain in force for the part unaffected by that clause.
